Patna High Court CR. MISC. No.58380 of 2022(2) dt.22-12-2022 2/3 The petitioners apprehend their arrest in connection with Gaya Rail P.S. Case No.97 of 2022, registered for the offences punishable under Sections 147, 149, 341, 323, 324, 325, 379, 385, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the allegations against the petitioners are not specific. It is submitted that some injuries are simple in nature and opinion regarding nature of some injuries are reserved.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioners is rejected.

However, if petitioners surrender before the learned court below within a period of six weeks from today and pray for regular bail, the learned court below shall consider the
