This petition has been filed for modification of order dated 14.07.2015 passed in Cr. Misc. No. 23195 of 2015 and for extending the period of surrender of the petitioners. It is submitted that grand father of petitioners fell ill and, therefore, the petitioners could not surrender within four weeks from the date of order.
It appears that petitioners were granted anticipatory bail vide order dated 14.07.2015 but the petitioners did not surrender in the court below for more than seven months and filed this petition on 15.02.2016 annexing a medical certificate about the illness of grand father of petitioners No. 1 and 2. The medical
Patna High Court Cr.Misc. No.7661 of 2016 (2) dt.20-07-2016 2/2 certificate shows that the patient was suffering from jaundice. The reason shown for not surrendering the petitioners does not appear to be sound one.
I do not find any merit in the modification petition. Accordingly, the same is dismissed.
