The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 447, 379/34 of the Indian Penal Code and 3/4 of Prevention of Witch Practices Act.
The accusation is of addressing the informant as a witch and administering night soil. It is submitted by learned counsel for the petitioners that due to the land dispute between the wife of petitioner no. 1 and the informant the present case has been
Patna High Court Cr.Misc. No.53671 of 2015 (2) dt.26-11-2015 2/2 lodged when wife of petitioner no. 1 has filed Complaint Case No. 2132 of 2015 against the informant, though, subsequent to the lodging of the present case.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Yogapatti (Sanichari) P.S. Case No. 283 of 2015 pending in the court of learned Chief Judicial Magistrate, Bettiah, West Champaran.
With the aforesaid observation, this application is disposed of.
