The petitioner seeks bail in a case registered under Sections 341, 342, 307, 386, 387, 34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case in short is that the accused persons having pistol in their hand came at the shop of the informant and and threatened him of dire consequences and also took Rs. 7000/-.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 10-07-2019. Charge sheet has already been submitted. The petitioner has been
Patna High Court CR. MISC. No.60555 of 2019(2) dt.24-09-2019 2/2 falsely implicated in the present case. None is said to have sustained injury in the present case. No offence u/S 307 of the Indian Penal Code is made out. The petitioner undertakes to cooperate during the trial.
On behalf of the State and the informant, it is submitted that the petitioner is named in the Complaint Case/F.I.R. It is also submitted that the petitioner threaten the informant from time to time.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Majhaul at Begusarai in connection with Cheirya Bariyarpur P.S.
