Patna High Court CR. MISC. No.71417 of 2021(2) dt.13-06-2022 2/3 APP for the State.
Learned counsel for the petitioners undertake to remove the defects, as pointed out by the office within three weeks on resumption of physical mode, failing which the office is directed to place the matter before the Bench. The petitioners apprehend their in case registered for the offence punishable under Sections 109, 143, 144, 145, 188, 379, 384, 427, 436, 447, 448 of the Indian Penal Code. Allegation against the petitioners is that they entered the house of the informant and on the order of petitioner No.1, all accused persons looted the household articles and also damaged motorcycle and further allegation is to set the house on fire situated at Nahar.
Learned counsel for the petitioners submits that the petitioners are quite innocent and have not committed any offence and have falsely been implicated in this case. Learned counsel for the petitioner further submits that this case is counter blast of the earlier case bearing Nautan (Jagdishpur) P.S. Case No. 241 of 2020.
There is general and omnibus allegation against the petitioners and the petitioners have got no criminal antecedent as stated at para 3 of the bail petition.
Patna High Court CR. MISC. No.71417 of 2021(2) dt.13-06-2022 3/3 Learned APP for the State opposed the prayer for bail petition.
Considering the above facts and circumstances, the petitioners, above-named, in the event of their arrest or surrender, within six weeks from today, is directed to be released on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Nautan (Jagdishpur) P.S. Case No. 243 of 2020, subject to the condition as laid down under Section 438(2) Cr.P.C.
The application stands allowed.
