2. The petitioner seeks bail in connection with a case registered for the offence punishable under Sections 302, 307, 120B, 34 of the IPC.

3. Allegedly, all the FIR named accused persons including the petitioner are said to have been involved in the murder of the son of the informant.

4. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. No such occurrence as alleged has ever taken place. He has been falsely implicated in this case due to ulterior motive. The allegation levelled against the petitioner is totally false and based on concocted facts. There is no specific overt act against the petitioner. There is specific allegation against

Patna High Court CR. MISC. No.67359 of 2024(2) dt.20-09-2024 2/2 co-accused Mohammad Firdos and Monu Sharma. Petitioner is not named in the FIR. During investigation, he was made accused in the present case. It is further submitted that coaccused, namely, Monu Sharma, who is prime accused in the present case, has been granted regular bail by a co-ordinate Bench of this Court vide order dated 24.08.2023 in Cr. Misc. No. 34924 of 2023. He further submits that petitioner has two criminal antecedent and he is in custody since 09.02.2024.

5. Learned APP for the State opposes the prayer for bail.

Having regard to the facts and circumstances of the case, since co-accused, namely, Monu Sharma has been granted regular bail by a co-ordinate Bench of this Court, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Shikarpur P.S. Case no. 975 of 2022. (Anjani Kumar Sharan, J) devendra/- U T
