2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 341, 323, 354, 354B, 504, 506/34 of the Indian Penal Code and Sections 8, 12 and 18 of the Protection of Children from Sexual Offences Act.
3. The case of the prosecution is that the petitioner gave biscuit and two hundred rupees to the minor daughter of the informant and teased her.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has
Patna High Court CR. MISC. No.63694 of 2024(3) dt.26-10-2024 2/2 committed no offence. He has been falsely implicated in this case. The wife of the petitioner has also filed a case with similar allegation against the husband of the informant. It is also submitted that the occurrence is of 28.01.2024 whereas the F.I.R. was lodged on 03.02.2024. On perusal of the record, it is clear that the parties are inimical and the allegations are only of teasing a minor girl. The petitioner is in judicial custody since 28.06.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-cumSpecial Exclusive Judge, POCSO, Aurangabad in connection with Mahila P.S. Case No. 08 of 2024.
