JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 379 and other ancillary sections of the Indian Penal Code. Learned counsel for the petitioner submits that earlier prayer for bail of the petitioner was rejected by this Court vide order contained in Annexure 1 observing that the petitioner is assailant of the deceased, whereas in paragraph 9 of the bail petition, petitioner has averred that the victim Shambhu Sah is alive and presently he is working as a teacher at Haji Mohiuddin Primary School, Ram Vishanpur, Ward No.9, District Supaul. He further submits that charges have been framed and the case is running for prosecution evidence.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IV, Supaul in Sessions Trial No. 01/2021.
