2. The petitioner seeks bail in connection with Lakhnaur P.S. Case No. 08 of 2025 instituted for the offences under Section 303(2) of the Bhartiya Nyaya Sanhita, 2023.
3. As per prosecution case, the motorcycle of the informant was stolen by unknown person/s.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. He further submits that there is delay of two days in lodging the F.I.R. that too without there being any plausible explanation for the same which creates doubt in the veracity of the prosecution case. He further submits that in course of investigation, the alleged motorcycle has been recovered from the garage of the
Patna High Court CR. MISC. No.57307 of 2025(2) dt.27-08-2025 2/2 petitioner but, the petitioner was not aware that the alleged motorcycle was stolen as he runs the alleged garage. The petitioner has three criminal antecedents and is languishing in judicial custody since 28.02.2025 without any rhymes or reason. Learned counsel for the petitioners again submits that the coaccused have been granted bail by a Co-ordinate Bench of this Court vide orders dated 16.07.2025 and 31.07.2025 passed in Cr. Misc. Nos. 43070 of 2025 and 45738 of 2025.
6. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Lakhnaur P.S. Case No. 08 of 2025.
