JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code and Section 3(1)(v)(x) of the SC & ST (Prevention of Atrocities) Act. The prosecution case is that the government settled land in favour of the informant was encroached by one Pappu Kamat and when Circle Officer issued notice to the accused for removing the encroachment then accused persons assaulted the informant, abused by calling caste name and snatched Rs. 1000/- of the informant.

It is submitted by learned counsel for the petitioner that Land Dispute Case No. 235 of 2013 is pending between the informant and co-accused Pappu Kamat wherein the petitioner being lawyer was appearing on behalf of coaccused Pappu Kamat. Hence, petitioner has been roped in the present case. The accusation is omnibus and general and for

Patna High Court Cr.Misc. No.53252 of 2015 (2) dt.23-11-2015 2/2 the occurrence of 10.07.2015 the First Information Report was registered on 20.07.2015.

Considering the delayed lodging of the F.I.R and the thrust of accusation against co-accused Pappu Kamat, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa SC/ST P.S. Case No. 31 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
