The petitioners seek regular bail in connection with Bachchwara P.S. Case No. 45 of 2018, registered for the offence punishable under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding the accused persons having fired on the informant resulting in injury on his right chest. As far as the petitioner no. 1 is concerned, he is said to have fired on the right hand of the informant, however, as far as the petitioner no. 2 is concerned, there is no allegation of any overt act.

No.56779 of 2019(2) dt.01-10-2019 2/2 The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case inasmuch as the present case arises out of a case and a counter case. It is further submitted that as far as the petitioner no. 1 is concerned, he is an accused in one another case, but he is on bail in the said case and as far as the petitioner no. 2 is concerned, he is having a clean antecedent. Lastly, it is submitted that the main accused person, namely, Jito Yadav @ Jitendra Yadav has already been granted bail by a coordinate Bench of this Court by an order dated 27.9.2019 passed in Criminal Miscellaneous No. 59434 of 2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail. Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-VI at Begusarai in connection with Bachchwara P.S.
