2. The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 253 of 2023 instituted under Sections 504, 506 and 34 of the Indian Penal Code read with Section 27 of Arms Act.
3. As per the prosecution case, accused persons including the petitioner used filthy language against the girls residing near the house of the informant and when protest was raised, accused persons abused him and opened seven round firing.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He
Patna High Court CR. MISC. No.60420 of 2023(2) dt.11-10-2023 2/2 has falsely been implicated in this case due to village politics. He has no criminal antecedent. Nothing has been recovered from the possession of the petitioner. Due to dispute for the common passage, this case has been lodged.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. III, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 253 of 2023, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
