Petitioner seeks bail in connection with Kargahar P.S. Case No. 206 of 2013 registered for the offences under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act in which Section 302 IPC was added later on. The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 04.03.2014 passed in Criminal Misc. No. 52300 of 2013, on the ground that the petitioner is in custody since 26.07.2013 and in near future the trial is not likely to be concluded which is apparent from the report of learned trial Judge as up-till now only one prosecution witness has been examined.
Learned A.P.P. opposes the prayer of bail.
Patna High Court Cr.Misc. No.53704 of 2015 (3) dt.18-01-2016 Finding no good ground for reconsideration of prayer of bail of the petitioner, his prayer for bail is again rejected.
However, considering the period of detention of the petitioner, the learned trial Judge is directed to conclude the trial as early as possible, preferably within 6 months from the date of receipt/communication of this order.
