Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Petitioner seeks bail who is in custody since 28.06.2016 in connection with S. T. No. 844 of 2016 arising out of Phulwarisharif P.S. Case No. 355 of 2016, F.I.R. dated 27.06.2016 for the offences punishable under Sections 302, 307 and 324 of the Indian Penal Code.

According to prosecution case, the father of the informant has murdered of his wife i.e. mother of the informant by means of knife.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.57695 of 2022(4) dt.11-04-2023 2/2 petitioner has clean antecedent and he has falsely been implicated in the present case and the petitioner is in custody since 28.06.2016.

Vide order dated 27.02.2023 a report was called with regard to the present stage of trial. Report of the learned Trial Court dated 02.03.2023 reveals that out of 5 witnesses, all the 5 witnesses have already been examined.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner. Considering the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with S. T. No. 844 of 2016 arising out of Phulwarisharif P.S. Case No. 355 of 20216 pending in the court of learned Additional District & Sessions Judge VIII, Patna.

Prayer is refused.

However, the learned Trial Court is directed to expedite and conclude the trial at the earliest. (Rajesh Kumar Verma, J) Vanisha/- U T
