09-11-2017 Heard Sri Uday Bhanu Roy, learned counsel assisted by Sri Sunil Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Palasi P.S. Case No. 168 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(G) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
It was submitted by learned counsel for the petitioner that it is a peculiar case, in which, petitioner has been made accused on accusation that from a place, near the chicken shop of the petitioner, there was recovery of 10 bottles containing 100 ml. of cough syrup each and petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the
Patna High Court Cr.Misc. No.53721 of 2017(2) dt.09-11-2017 2/2 petition.
Considering the nature of accusation as well as clean antecedent of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Ramjan be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge, Araria in connection with Palasi P.S. Case No. 168 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
