The petitioner seeks pre-arrest bail in connection with Vaishali P. S. Case No. 13 of 2017 registered under Sections 323, 324, 307, 504, 506, 354, 341, 342, 447 and 379/34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that there is case and counter case. The petitioner had sustained serious injuries in the incident as a result of which he was treated in PMCH since 12.01.2017 to 31.01.2017. The father, mother and brother of the petitioner had sustained injury in the said incident and they were also treated in PMCH. He
Patna High Court Cr.Misc. No.58366 of 2017 (2) dt.12-12-2017 2/2 submitted that co-accused Satish Rai @ Satish Kumar and Bharat Rai @ Bharat Kumar having more or less identical allegations have already been granted pre-arrest bail. Learned Additional Public Prosecutor for the State has opposed the prayer for pre-arrest bail to the petitioner. Considering the facts and circumstances of the case, the petitioner named above, who is said to be a young boy of 20 years having clean antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in Vaishali P. S. Case No. 13 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
