The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 406, 323, 341, 504, 506, 34 of the Indian Penal Code.

Basic accusation is of torture.

It appears from the impugned order that the petitioner was granted provisional anticipatory and, thereafter, the petitioner executed bail bonds in pursuance of the same. Considering the fact once the petitioner executed bail bond, he was in deemed custody of the Court, hence, his prayer for anticipatory bail is not maintainable.

Let the learned Court below consider the prayer for

Patna High Court Cr.Misc. No.8380 of 2016 (2) dt.19-02-2016 2/2 regular bail of the petitioner, keeping in view of the fact that both the sides are ready to reconcile the issue, if the petitioner surrenders within a period of six weeks in connection with Mahila P.S. Case No.61/2015, pending before the learned ACJM-III, Rohtas at Sasaram.

With the above observation, this application is, accordingly, disposed off.
