JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2019 This application, for grant of anticipatory bail, arises out of Uchakagaon P.S. Case No. 82 of 2019, disclosing offences under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Allegation is of recovery of 113.310 ltres of liquor from the Tata Safari vehicle and two persons were arrested and they disclosed that the name of one Prem Parwat as main person and the name of petitioner as the associate of said Prem Parwat. Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case only on the disclosure of apprehended accused persons and except that there is nothing against the petitioners.
Learned counsel for the State opposed the prayer for
Patna High Court CR. MISC. No.56466 of 2019(2) dt.05-09-2019 2/2 bail but conceded that the name of petitioner has been disclosed by the co-accused of this case.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum Special Judge Excise, Gopalganj, in connection with Uchakagaon P.S. Case No. 82 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
