The petitioner is in judicial custody in connection with Ekchari P.S. Case No. 14 of 2015 (G.R. No. 3100/2015) for the offences under Sections 147, 148, 149, 323, 455, 382 and 385 of the Indian Penal Code.
The matter is of the year 2015 and the petitioner finally chose to come into judicial custody in 2021. In between two criminal cases were lodged against him vide Ekchari P.S. Case No. 35 of 2018 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act and Kursela P.S. Case No. 78 of 2017 registered under Sections 302, 120(B)/34 of the Indian Penal
Patna High Court CR. MISC. No.69829 of 2021(3) dt.30-08-2022 2/2 Code. Not only the petitioner evaded arrest as per paragraph-3 of the bail application, it has falsely been submitted that he has no criminal antecedent.
Taking into account the conduct of the petitioner, this Court is not inclined to grant him the privilege of bail which is accordingly rejected.
Since the case is of the year 2015, the trial Court is hereby directed to expedite the trial and conclude the same preferably within a period of one year.
