The petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414 and 34 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 02.07.2021, charge-sheet has been submitted in the case and has antecedent of one case. It is submitted that the said case also arises from the present case in which the petitioner is seeking bail.

Learned counsel for the petitioner submits that the allegation is of recovery of one country-made pistol, one live cartridge along with a blue colour Swift Dzire car and other

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, nothing was recovered from his possession and he is a businessman.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and taking into consideration the submissions with respect to petitioner's antecedent as pleaded in paragraph '3' of the bail application, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Saraiya P.S.
