The petitioner is apprehending arrest in a case registered for the offences punishable under sections 376/511 of the IPC. The prosecution case is that on 24.5.2015 at 11 P.M. the petitioner entered into the room of the informant who happens to be his sister-in-law (younger brother's wife) and tried to ravish her.

It is submitted by learned counsel for the petitioner that the petitioner lodged Khagaria P.S. Case No. 332 of 2015 on 23.5.2015 with accusation under sections 341,342,323,324,379 and 504/34 of the IPC against the husband of the informant and his father and thereafter the present case has been registered on 10.7.2015 for the occurrence of 24.5.2015.

It is further submitted that the case lodged by the petitioner side is earlier in point of time and on conclusion of investigation the petitioner has not been sent up for trial. Considering the aforesaid facts, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Khagaria P.S.
