The petitioner apprehends his arrest in connection with Sikroul P.S. Case No. 61 of 2019, registered under Section 30(a) of the Bihar Excise Act, pending in the court of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Buxar.

The accusation is of recovery of 23 bottles each containing 180 ml Indian made foreign liquor from the house of the petitioner.

Learned counsel for the petitioner submits that the alleged Indian made foreign liquor, was recovered from the joint house of the petitioner and at that time, petitioner was not

Patna High Court CR. MISC. No.56741 of 2019(2) dt.06-09-2019 2/2 present. In fact, petitioner had no knowledge about keeping the aforesaid seized liquor, which was kept his family members. The petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
