====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Agrer P.S. Case No. 73 of 2018 registered under section 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the I.P.C. The allegation against the petitioner, as per the first information report, is that the petitioner along with other accused persons surrounded the informant and at the behest of Bishwanath Singh and Bihari Singh, petitioner assaulted on the head of informant by means of iron rod causing injury. Learned counsel appearing for the petitioner submits that both the parties are co-sharer and there is a land dispute between them. Learned counsel further submits that the injury caused to the informant has been found to be simple in nature

Patna High Court CR. MISC. No.55629 of 2019(2) dt.04-09-2019 2/2 which has been annexed as Annexure-2 with this application. After having heard learned counsel for the parties and taking into consideration the fact that both the parties are cosharer and the injury caused to the informant is simple in nature, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner, above named, in the event of arrest or surrender before the learned Court below within a period of four weeks from today shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt Vibha Rani, learned Judicial Magistrate-II, Sasaram in connection with Agrer P.S. Case No. 73 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
