2. The petitioners apprehend arrest in connection with K. Nagar P.S. Case No. 101 of 2025 instituted under Sections 316(5), 318(4), 61(2) of B.N.S.

3. As per the prosecution case, petitioners are alleged to have committed scam of about Rs. 1 crore.

4. Learned counsel for the petitioner submits that the main allegation of misappropriation is against petitioner no. 1. Petitioner no. 2 is the wife of petitioner no. 1. Petitioners have clean antecedent.

5. Learned APP for the State has opposed the prayer

Patna High Court CR. MISC. No.57954 of 2025(6) dt.20-02-2026 2/3 for anticipatory bail of the petitioners.

6. Considering the fact that the main allegation of defalcation of money is against petitioner no. 1, therefore, this is not a fit case for grant of anticipatory bail with respect of petitioner no. 1.

7. Accordingly, the application stands dismissed with respect of petitioner no. 1.

8. The petitioner no. 1 is directed to surrender within two weeks from today and pray for regular bail, failing which the Superintendent of Police, Purnea will take all steps for arrest of the petitioner no. 1.

9. So far as petitioner no. 2 is concerned, she is woman and there is no specific allegation against her, therefore, let the petitioner no. 2, above named, in the event of her arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Purnea/ concerned Court below in connection with K.Nagar P.S. Case No. 101 of 2025, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.

10. This application stands partly allowed.
