JUSTICE SUDHIR SINGH ORAL ORDER 08-01-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in a case registered under Sections 419, 420, 447, 448, 465, 467, 471, 379, 506 and 120B of the Indian Penal Code.
Earlier anticipatory bail application of the petitioner was ordered to be dismissed as withdrawn vide Annexures- 1& 2 to the present application. No order on merit was passed. Hence, the present application has been preferred on behalf of the petitioner to consider the case of the petitioner on merit. Allegedly, the accused persons having transferred several plots of the committee illegally, committed cheat of crores of rupees of the members of the Management Committee of Jai
Patna High Court CR. MISC. No.2821 of 2019(4) dt.08-01-2020 2/3 Prakash Nagar Shakti Grih Nirman Samiti. It is further alleged that co-accused Prem Prakas Verma and his family members fled away taking all the documents of the committee. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. The petitioner is a lady aged about 60 years. Nothing specific has been alleged in the FIR against the petitioner. The petitioner is not even office bearer in the cooperative society in question. The main allegation is against the co-accused Prem Prakash Verma who is alleged to have misappropriated the funds of the cooperative society and, further had taken away the documents of the cooperative society. No document whatsoever has been executed by this petitioner. The other co-accused with similar allegation have been granted anticipatory bail either by this court or by different benches of this court vide Annexure-4 series and 5 to the application.
On behalf of the State and counsel for the informant, it is submitted that the petitioner is named in the Complaint Case/F.I.R. She happens to be wife of the main accused namely Prem Prakash Verma. She had an instrumental role in the entire

Considering the aforesaid facts and circumstances, the petitioner, above named, in the event of her arrest or surrender in the court below within six weeks shall be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Akhilesh Kumar Pandey, learned Judicial Magistrate-Ist Class, Patna in connection with Digha P.S. Case No. 89 of 2015.
