JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25 (!-B)a, 26 and 35 of the Arms Act.

On information that miscreants are preparing to commit dacoity, raid was laid leading to arrest of three persons from whom arms were recovered when two persons escaped from the scene and one of them was found to be the petitioner. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and only on suspicion, the accusation has been levelled.

Considering the fact that the case was registered in the year 2012 and the petitioner was named in the FIR, it is a case for

Patna High Court Cr.Misc. No.56662 of 2015 (2) dt.15-12-2015 2/2 consideration of regular bail if the petitioner surrenders within a period of six weeks in connection with Jakkanpur P.S. Case No. 203 of 2012 pending in the court of learned JM, 1st Class, Patna. Accordingly, the application is disposed of.
