Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 47 (A) (F) of the Excise Act.
It is alleged that 440 liters of country made liquor was recovered from the house, when petitioner along with others were found distilling the country made liquor. It is submitted by the learned counsel for the petitioner that the house from where the seizure was made belongs to one Kallu Manjhi, which was being hired by Santosh Sao and petitioner has only been roped in the present case due on suspicion. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.3898 of 2016 (2) dt.27-01-2016 consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Excise Case No. 74 of 2012, pending in the court of learned Akansha Kashyap, J.M., Ist Class, Gaya.
With this observation this application is disposed of.
