JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Supaul P. S. Case No. 129 of 2017, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 379, 504 and 307 of IPC.

From the perusal of the record, it appears that petitioner has earlier moved for grant of anticipatory bail to the petitioner, which was rejected, vide order dated 21.07.2017 passed in Criminal Misc. No. 34303 of 2017 by a Co-ordinate Bench of this Court.

There is allegation against the petitioner is of assault to the informant by Axe, causing injury.

Submission of the learned counsel for the petitioner is that as now after investigation charge sheet has been submitted under Section 308 of IPC, as such, petitioner has filed the second anticipatory bail application.

Patna High Court CR. MISC. No.60197 of 2019(2) dt.24-09-2019 2/2 Heard learned A.P.P. also.

Having heard both sides, from the perusal of the record, it appears that earlier order was passed in the year 2017 and the prayer for anticipatory bail of the petitioner was rejected on the ground that informant has received altogether five injuries and one of the injury was on right parietal region, caused by sharp cutting weapon, in view of the above, I am not inclined to grant privilege of anticipatory bail to the petitioner. He is directed to surrender before the learned court below and make prayer for regular bail.
