The petitioner who is in custody since 13.7.2015 in connection with Phulwari Sharif (Janipur) P.S. Case No. 486 of 2015 registered for the offence punishable under Section 414 / 34 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on the basis of confession of one of the accused recovery of a motor cycle alleged to be stolen was shown recovered from a place, not from conscious possession of the petitioner. The petitioner is having clean antecedent and he is lying in jail since long.

Patna High Court Cr.Misc. No.55245 of 2015 (2) dt.17-12-2015 2/2 Learned A.P.P. has opposed the prayer of bail. Keeping in view the nature of accusation, period of custody as well as clean antecedent of the petitioner, which has been mentioned in paragraph no. 3 of the petition , let the petitioner Ajay Kumar Pandey be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Sema Eram, Judicial Magistrate 1st Class, Patna in connection with Phulwarisharif (Janipur ) P.S. Case No. 486 of 2015. (Rakesh Kumar, J) Praful/- U T
