2. The petitioner apprehends his arrest in connection with Supaul P.S. Case No. 87 of 2021 registered under Section420 of the Indian Penal Code and Section 10 of the Bihar Examination Conduct Rules.

3. As per prosecution case, in connivance, in place of the petitioner, co-accused Ajay Kumar was giving his Intermediate examination.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to suspicion. Further submission is that petitioner is no way connected with the allegation of cheating as admit card of the petitioner was lost

Patna High Court CR. MISC. No.64139 of 2024(2) dt.27-09-2024 2/2 somewhere which was erroneously being used by co-accused person in giving exam. Similarly situated co-accused has already been granted bail by this Court vide order dated 07.02.2024 passed in Cr. Misc. No. 670 of 2024. Petitioner is a student and claims clean antecedent.

5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and similarly situated co-accused has already been granted bail, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 87 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
