Petitioner apprehends his arrest in connection with Turkauliya P.S. Case No.466 of 2023 dated 16.04.2023, registered for the offence punishable u/s 304/ 308/ 328/201/34 of the IPC and section 33/ 34/ 37/ 41 of Bihar Prohibition and Excise Act, 2018, pending in the Court of learned Exclusive Special Excise Court No.-I, Motihari, East Champaran. 3.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that some of the co-accused have been granted anticipatory bail by the co-ordinate Bench of this Court.
