JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner is accused in connection with Economics Offences P.S. Case No. 08 of 2015 registered under Sections 419, 420, 468, 469 472 and 120(B) of the I.P.C.
The accusation is that after opening the two websites, advertisement was published for filling up 5842 different posts in BSNL Department showing the account no.
6565002100001686 of PNB in the name of Bharat Services for depositing fee of Rs. 500/-.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.9479 of 2016 (3) dt.28-04-2016 2/3 petitioner submits that petitioner is not named in the F.I.R. In course of investigation, account was found open in the name and parentage of the petitioner, as detailed in paragraph no.47 of the case diary. Later on, the account number was found open in the actual name and address of the petitioner at Canara Bank, Saguna More, Patna, which was closed on 24.03.2015. Thereafter, the petitioner was apprehended on 03.09.2015 since then he is in custody and on search, no incriminating has been recovered from the house of the petitioner.
On the other hand, learned counsel for the opposite party, Economic Offences Unit, Patna submits that the account is opened in the name and parentage of the petitioner in PNB and on verification it was found that the account was opened in the name of petitioner with his parentage on the basis of address of rented house of the petitioner. Admittedly, charge-sheet has already been submitted against the petitioner and the petitioner is in custody since September, 2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Patna in connection with Economic Offence P.S. Case No. 08 of
Patna High Court Cr.Misc. No.9479 of 2016 (3) dt.28-04-2016 3/3 2015. Out of two sureties, one surety must be the close relatives/parents of the petitioner, who will file an affidavit showing his relation with the petitioner and further the petitioner shall remain present on each and every date during the course of trial in the Court below. If the petitioner fails to remain present on two consecutive dates during the course of trial without any reasonable cause, the Court concerned would be at liberty to take steps for cancellation of his bail bonds.
