In this case, the petitioner is seeking anticipatory bail in connection with Deedarganj P.S. Case No. 193 of 2019, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation has been made that while the deceased was trying to pacify the quarrel, on the order of co-accused Nago Singh @ Nagendra Singh, the petitioner and his brother Rajniti Singh @ Bhorik Singh assaulted the deceased and, thereafter, Rajniti Singh @ Bhorik Singh has fired upon the deceased causing his death.

Counsel for the petitioner submits that allegation

Patna High Court CR. MISC. No.60005 of 2019(3) dt.20-11-2019 2/2 has been made against co-accused Rajniti Singh @ Bhorik Singh and there is no allegation against the petitioner. He further submits that only one bullet injury has been found on the body of the deceased and, as such, it is Rajniti Singh, who have caused injury on the body of the deceased.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner.
