JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 684 litres of English Wine liquor has been recovered from the hut situated inside banana orchard.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Banana orchard in question does not belong to the petitioner. Petitioner has got no criminal antecedent.
