1. Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 498A, 307, 379, 354(B) and 34 of the Indian Penal Code and Section 4 of the D. P. Act, but summon has been issued under Sections 498(A), 323, 354(A) and 34 of the I.P.C. and Sections 3 and 4 of the D. P. Act.
3. Ms. Nidhi, the learned counsel appearing on behalf of the opposite party no.2 submits that she has instructions to
Patna High Court CR. MISC. No.64296 of 2023(5) dt.23-04-2024 2/2 make submission not to oppose the anticipatory bail of the petitioner as on intervention of well-wishers, the dispute in between the petitioner and the opposite party no.2 stands resolved and they have decided to part ways.
4. Learned A.P.P. opposes the bail application.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned First A.C.J.M., Hilsa, Nalanda in connection with Complaint Case No.275(C) of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
