Petitioner seeks bail in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

A stolen motorcycle was allegedly recovered from the possession of the petitioner and co-accused. Submission is that seizure list does not show that recovery was from the possession of the petitioner. Moreover, a copy of the seizure list was not supplied to the petitioner. Petitioner has been implicated due to earlier criminal case lodged by the same Police Station, wherein petitioner was not named, nor the petitioner was apprehended by the Police. No.54804 of 2019(2) dt.05-09-2019 2/2 Information Report, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sonpur Police Station Case No.439 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
