The petitioner seeks pre-arrest bail in connection with Bounsi P.S.Case No.239 of 2017 registered under Sections 379 and 411 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner is the owner of the tractor bearing registration no.BR 51G-0240. He was not aware as to why the driver had loaded illegally mined sand on the trailer attached to the tractor. He submitted that the petitioner has got no criminal antecedent and having got roots in the society he is not likely to abscond or tamper with the evidence.

No.61195 of 2017 (2) dt.22-12-2017 2/2 submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Banka in connection with Bounsi P.S.Case No.239 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
