JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 41 and 42 of the Indian Forest Act and sections 5,7,9,10,11,13,14,16 and 17 of Saw Mill (Regulation) Rules.

The prosecution case is that the petitioner was running saw mill illegally and restrained the forest officials to make seizure.

It is submitted by the learned counsel for the petitioner that there is no seizure which suggests that the case has maliciously been lodged.

Considering the fact that the case was registered in 2010,

Patna High Court Cr.Misc. No.10536 of 2016 (2) dt.08-03-2016 2/2 this court is not inclined to interfere in the matter. However, in view of the fact that no seizure was made, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Misc. Forest Case No. 38 of 2010 pending in the court of learned A.C.J.M. II, Supaul.

This application is disposed of with the aforesaid observation/direction.
