JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was on bail in Bhaptiyahi P.S. Case No. 53 of 2013 corresponding to Sessions Trial No. 68 of 2015 and having entrusted his pairvi to his learned counsel, petitioner had gone outside the State in connection with his livelihood but on 18.01.2016 his counsel could not appear before the court when case was called out as the prosecution had filed attendance of a prosecution witness and due to non appearance of learned counsel of the petitioner, the petition filed under Section 317(2) of the Cr.P.C. on behalf of the petitioner was rejected and warrant of arrest was issued against him.
It is submitted on behalf of the petitioner that as soon
Patna High Court Cr.Misc. No.9647 of 2016 (2) dt.29-02-2016 2/2 as the petitioner got information in respect of cancellation of his bail bond, he voluntarily surrendered before the court below on 10.02.2016 and since then he is languishing in jail custody. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Supaul in connection with Sessions Trial No. 68 of 2015 arising out of Bhaptiyahi P.S. Case No. 53 of 2013.
