JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 18-04-2016 Heard the counsel for the petitioners and Mr. Pradeep Narayan Kumar, APP for the State.

The five petitioners herein seek anticipatory bail in Murliganj P.S. Case No. 18 of 2010 punishable under Sections 384/31 of the Indian Penal Code.

It is stated that a complaint was lodged against the informant who is in-charge Head Master at Middle School, Dumaria, on which a criminal case has been registered vide Annexure-2. This case is lodged in retaliation. The present case has been lodged in which the police upon investigation did not send up the accused(s) for trial. Now the Court has taken

Patna High Court Cr.Misc. No.12460 of 2016 (3) dt.18-04-2016 2/2 cognizance differing with the report hence apprehension. The petitioners have no criminal antecedents.

In the facts and circumstances of the case, let the petitioners above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in Murliganj P.S. Case No. 18/2010 on condition that one of the bailors shall be his/their own/close family member. The petitioners shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel their bail bonds. (Kishore Kumar Mandal, J) rohit/- U T
