JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-05-2022 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing for the State. Petitioners seek regular bail in connection with Sugauli P.S. Case No. 340 of 2021 registered for the offences punishable under Sections 147, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code 1860.

The allegation, as per the First Information Report, is that the petitioner No. 1 has allegedly assaulted the informant by means of iron road, petitioner Nos. 2 and 3 assaulted the informant with fists and kick, due to which, the informant sustained injury.

No.69800 of 2021(2) dt.24-05-2022 2/2 Learned counsel for the petitioners submits that petitioner No. 1 and the informant are own brothers, petitioner No. 2 is son of petitioner No. 1 and petitioner No. 3 is nephew of petitioner No.1. He further submits that there is long standing land dispute between the parties and petitioner No. 1 is about 85 years old. The petitioners are in custody since 4.9.2021 and 10.10.2021 respectively.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that both the parties are close relatives, petitioner No. 1 is 85 years old and is in custody since 4.9.2021, and allegation against petitioner Nos. 2 and 3 is that they assaulted the informant by fists and kick, I am inclined to grant regular bail to the petitioners.

Accordingly, let the petitioners, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Sugauli P.S. Case No. 340 of 2021.
