Petitioner seeks regular bail in connection with Ara Muffasil PS Case No. 110 / 2021 registered under Section 25 (1-B)a / 26 / 35 of the Arms Act.

As per the First Information Report one loaded country made pistol and a cash of Rs. 80,000/- has been recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged . He next submits that no fire arms and / or incriminating article has been recovered from the possession of the petitioner. Insofar as recovery of cash is concerned, he submits that petitioner had kept the same for his personal use. Learned counsel further

Patna High Court CR. MISC. No.70048 of 2021(2) dt.24-05-2022 2/2 submits that petitioner is a student and statement to this effect has been made in paragraph - 11 of the bail petition. The petitioner is in custody since 05 / 05 / 2021 , charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence if released on bail. Regard being had to the submissions made by the parties, taking into consideration the materials available on record, the fact that petitioner is in custody since 05-05-2021, charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence if released on bail, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Bhojpur at Ara in connection with Ara Muffasil PS Case No. 110/ 2021.
