The petitioner is in custody in a case registered for the offences punishable under Sections 30(a) of the Bihar Excise Prohibition Amendment Act, 2018.

Allegedly, it is a case of recovery of 232.20 liters of illicit liquor from a tempo.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that he has no concern with the seized liquor as well as the tempo and no any incriminating article has been recovered from the conscious possession of the petitioner as well as petitioner is in judicial custody and petitioner has clean antecedent.

No.69477 of 2022(2) dt.06-01-2023 2/2 Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge ExciseII, Aurangabad (Bihar) in connection with Goh P.S. Case No. 99 of 2020.
