The petitioner apprehends his arrest in connection with Kishanganj P.S. Case no. 461 of 2018, registered under Section 135 of the Electricity Act.
The accusation is that informant being the Junior Electrical Engineer, Electric Supply Section, Kishanganj (Urban) made raid on 09.07.2018 in the premises of Sanjeet Kumar Karn (Petitioner) then found that one Smt. Sushmita Devi, wife of Rishikesh Lal Karn, resident of Dumriya, Kishangnaj had taken connection bearing consumer No.
Patna High Court CR. MISC. No.8880 of 2019(3) dt.08-05-2019 2/3 400749649/DMR/DS2/6096 and her electric connection was closed due to dues of Rs. 96426/-. Thereafter, petitioner again applied for electric connection on 02.11.2017, but the electric connection could not be established due to earlier dues, but it was found that petitioner was using electric energy by putting hook and as such the department has suffered loss total of Rs. 96426+36808=133232/- Learned counsel for the petitioner submits that, admittedly, the petitioner applied for electric connection on 02.11.2017 and as per F.I.R. the electric connection was not given and petitioner consumed electric energy worth of Rs. 36808/-. Further submission is that petitioner is ready to deposit Rs.
36808/-, which is said to be caused loss to the electricity department by putting hook by this petitioner. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No.
