The petitioner apprehends his arrest in connection with Madhubani P.S. Case No. 273 of 2015 for offences punishable under Sections 147, 149, 341, 323, 332, 333, 224, 225, 307, 353, 427, 440, 504 and 506 of the Indian Penal Code and Section 3(i) (x) of the Scheduled Caste / Scheduled Tribe (Prevention of Atrocities) Act.
Mr. Mishra, learned counsel for the petitioner with reference to the FIR submits that the allegation is directed against six named accused and 60 unnamed accused and all of them have been, in an omnibus manner, charged with abusive language on the petitioner as well as being a party to the forcible release of
Patna High Court Cr.Misc. No.54974 of 2015 (2) dt.21-12-2015 accused Satya Narayan Mishra.
Having heard learned counsel for the parties and considering the nature of allegations present in the FIR, let the petitioner, namely, Bhawesh Mishra in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani and/or the court concerned in connection with Madhubani Town P.S. Case No. 273 of 2015, G.R. No. 1905 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Jyoti Saran, J) S.Sb/- U T
