Mr.Md. Ataur Rahman ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 30-08-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
Petitioners apprehend their arrest in connection with Bhahampur P.S. Case No.220 of 2019 for the offence punishable under Sections 341, 342, 323, 448, 308 and 379/34 of the Indian Penal Code.
The allegation against the petitioners, as mentioned in
Patna High Court CR. MISC. No.54972 of 2019(2) dt.30-08-2019 2/3 the FIR is that on 16.05.2019, two persons namely, Pradeep Ram, petitioner No.1 and Kuldeep Ram, petitioner No.2 entered into the house of informant and took away attachi (suit case) having some ornaments and currency. It has further been alleged that in the next morning, the informant went to the house of petitioners and asked about his article, petitioners assaulted him and his grand son by means of lathi, danda etc who sustained injury on the head.
Learned counsel for the petitioners submits that both the parties are agnates and there is case and counter case between them inasmuch as the side of the petitioners have lodged Brahampur P.S.Case No.221 of 2019 for the same incidence. Learned counsel further submits that Annexure-2 is the injury report of Arvind Ram, grand son of informant and from perusal of the injury report, it is apparent that injury caused to him is simple in nature. Learned counsel also submits that both the parties have entered into compromise and has submitted joint petition before the Court of C.J.M., Buxar, the certified copy of which has been produced before this Court which is kept on record.
After having heard learned counsel for the petitioners as well as learned counsel appearing on behalf of the State and

No.54972 of 2019(2) dt.30-08-2019 3/3 taking into consideration the fact that both the parties are agnates, there is case and counter case and injury caused to the informant is simple in nature and the parties have compromised their dispute amicably, as such, I am inclined to grant anticipatory bail to all the petitioners.
Accordingly, all the petitioners, above named, are directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by them, they shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
