2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 342, 307 and 504/34 of the Indian Penal Code.

3. As prosecution case, the allegation against the petitioner and other co-accused persons is that he assaulted the informant, his brother and sister-in-law by means of lathi and danda.

4. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has got no criminal antecedent. There is general and omnibus allegation against the petitioner. The nature of injury is found to be grievous in nature. There is case and counter case

Patna High Court CR. MISC. No.60478 of 2023(2) dt.13-10-2023 2/2 between the parties. There is no specific overt act against the petitioner.

5. Learned APP for the State opposes prayer for anticipatory bail.

6. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Sherghati (Dobhi) P.S. Case No. 498 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
