1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners seek bail in a case registered for the offence punishable under Sections 147, 149, 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

3. Learned counsel for the petitioners submits that petitioner no.1 has antecedent of three cases, petitioner no.2 and 3 have antecedent of one case and petitioner no.4 has antecedent of two cases. It is next submitted that co-accused Md. Saakib and two others had moved this court, seeking regular bail by filing Cr. Misc. No.62898/2024 and the same was allowed after considering the case on merits by an order dated 13.12.2024.

No.66608 of 2024(2) dt.13-12-2024 2/2 The learned counsel submits that the case of the petitioners is also on similar footing as petitioners are not alleged to have caused the death of the deceased, as allegation of firing is against Wasik and Jamil. It is next submitted that petitioners are in custody since 15.07.2024.

4. Learned A.P.P. opposes the prayer for bail of the petitioners.

5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, is directed to be released on bail on furnishing bail bonds of Rs.25000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Raniganj P.S. Case No.274/2023.

6. However, if the learned trial court comes to a conclusion that the petitioners after being released are trying to delay the trial in any manner, in that event, the learned trial court shall be at liberty to cancel the bail bonds of the petitioners.
