1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302 and 504 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioners no. 2 and 3 are women and the informant alleges that accused Krishna Kumar abused his brother Manjay Ram. On protest, Krishna Kumar assaulted the brother of the informant by bamboo peg. On alarm by Manjay Ram named accused persons including the petitioners came and started assaulting Manjay
Patna High Court CR. MISC. No.59945 of 2025(2) dt.11-09-2025 2/3 Ram, when his mother and cousin Dasai Ram and his wife came to save Manjay Ram accused assaulted them causing injury. Thereafter, the injured were taken to the hospital. Further, the next day when the informant came home from the hospital after treatment he saw that condition of his mother deteriorated and she died.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that allegation of assaulting the mother of the informant is general and omnibus in nature. It is next submitted that from the allegation as alleged in the FIR, it does not become clear as to whether the mother of the informant was also taken to the hospital for treatment or when the informant came back from the hospital to home after getting his brother treated he saw the condition of his mother deteriorating. It is also submitted that the police initially did not find the case true against the petitioners and submitted final form exonerating them but later on further investigation charge-sheet came to be submitted. It is submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Dhansoi P.S. Case No. 83 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
