The petitioner being the husband of the complainant is apprehending his arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 323 and 380 of the Indian Penal Code.

The basic accusation is of torture.

On submission of learned counsel for the petitioner that the admits his marriage with the complainant and ready to keep the complainant as wife with dignity and honour,

No.10369 of 2016 (4) dt.04-08-2016 2/2 though, statement to that effect has been made in paragraph 11 of the petition, the notices were issued to the complainantopposite party no.2, but it appears that on 20.07.2016 none appeared on behalf of the petitioner. Today, it is submitted by Mr. Jai Kishore Poddar, AOR No. 2939 that he has been instructed by Advocate on record Md. Kamran having AOR No. 05515, since is on legs, that, at present, there is no instruction from the petitioner.

In the circumstances, this application is disposed of.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with C.R.
